YONKERS, NY — August 16, 2020 — It was the Yonkers Tribune’s reporting that a (2) “Historic Bill to Criminalize Dumping of Construction Waste Passes Legislation” evoked memories that hearkened back 11years ago to 2009.
It catapulted this reporter’s memory to find the Investigative Report with the lede (3)“Junkyard Valiance Approval Outcome Exacts Detrimentally Outcome in Homefield By Hezi Aris.
The chronology of events demanded an update to what had transpired from 2009.
And so inquiry began in earnest.
After inquiry from Yonkers City Council President Mike Khader over the construction debris dumping ground located as Saw Mill River Road, and know of President Khader’s involvement in legal representation of those engaged in dumping toxic laden construction debris at the Saw Mill River Road property that was and remains under the ownership of Yonkers Zoning Board Chairman Joseph Cianciulli.

They found a partner in Joe Spiezio III who merged some of his carting operation with the Rogan Brothers.

Initially the Saw Mill River Road property

permitted to receive construction debris was limited by a 10-foot high perimeter wall.
Over time the mound of debris was said to have exceeded 20 feet, thereby permitting the toxic debris laden with asbestos and other harmful toxins to be lifted from the penned property by gusts of wind that carried the toxic waste as dust particles through the Homefield Section of Yonkers 6th District.  Yonkers Tribune Investigative Photographer.

Communication initiated by the Yonkers Tribune with some City Hallers advising them of the pending financial collapse of Joe Spiezio III’s business ventures was met with strong rebukes advising this reporter that Spiezio was not liable in any way no matter his financial situation.
With no forthcoming information from those expected to know, the issue was eclipsed by other concerns as they are when the news cycle demands immediate reporting.  Yonkers Tribune Investigative Photographer.

The “Historic Bill to Criminalize Dumping of Construction Waste Passes Legislation” reminded this reporter that the Saw Mill River Road property had yet to be cleaned, and so the recent introspection into and investigation that brought about whether the prospect of a “Quid Pro Quo Down the Road” was a logical and likely reality.
While none of the so-called culprits had likely cleaned the Saw Mill River Road property of its toxic debris, a photojournalist made the time to travel to the property to recognize that the property was in fact being cleaned up.
What seemed incongruous is why Yonkers City Hall chose not to divulge their forthright conduct and remediation of the property.
Further inquiry from those whose credibility is long proven to be flawless and correct revealed that the cleanup was not undertaken by Joseph Ciuncilli, the Rogan Brothers, R&S Carting, or Joe Spiezio.

The benevolent benefactor was none other than a major Yonkers developer

He is spending millions to clean-up the toxic property at his expense.

Not one penny from Yonkers City Hall

Alas, the Yonkers taxpayer is spared for the short term; it will eventually come out of their pocket.
But there was something very odd about this dynamic.
When people reach into their wallet to send a donation for some cause, whether it is $5, $10, $25, $50, or $100, it is unlikely they are looking for a “favor” in kind.
When the costs rise to $500, $1,000, $2,500, even $5,000, those who can afford such largesse are also giving from their heart and expecting nothing in return.
But when one considers that there are some 15 properties that have lain fallow in Yonkers for 15 years, most waterfront property, spending $3,500,000 seems way beyond magnanimous.
The Yonkers Tribune suggests the developer who continues to clean-up the Saw Mill River Road property is expecting to realize a “Quid Pro Quo”, after all, they are spending the money the taxpayer will not have to fork over for this expense in the near future.
And recognize that for every $3,000,000 in debt incurred by the city is equivalent to a tax increase of 1 per cent The clean-up is underway.
How much longer before the toxic dump is cleaned.
I don’t know.
What I do know is that the clean-up is close to being completed.
There is no option to back out of the scheme / scam now.

The developer will get his due: Quid Pro Quo

The prospect is that at the end, while all in government inform that the city will not pay a dime, the cost of giving away property for development by some other means for covering the $3 million plus clean-up will be born on the backs of the taxpayer.
Were the “deals” that permitted these misconducts not permitted, we wouldn’t be in this mess in the first place.
The last issue one should consider is whether the clean-up conformed to New York State Environmental Conservation regulations and where was the debris taken to and for what was it re-purposed.  What is the developer’s name.
It’s at the tip of my tongue, but like ketchup, the joy is in anticipation.

Rather than burst City Hall’s bubble

let us all resign in knowing that in time, we will all know when City Hall sends a press release to those that are on their email list.
Until then … its all about ketchup … anticipation.
Quid pro quo (“something for something” in Latin) is a Latin phrase used in English to mean an exchange of goods or services, in which one transfer is contingent upon the other; “a favor for a favor”.
Phrases with similar meanings include: “give and take”, “tit for tat“, “you scratch my back, and I’ll scratch yours”, and “one hand washed the other”.
